Your Rights After a Work Injury

By law, your Florida employer cannot stop you from filing a workers’ compensation claim when you suffer a work-related injury. Further, your employer cannot fire you for filing that claim. Florida, however, is a right-to-work state that favors employers and insurance companies over employees. Your employer can always terminate you on grounds other than your filing of a workers’ comp claim, for example, that your performance is sub-par or your position is no longer needed.

  • Get prompt medical treatment for your injuries.
  • Verify that your employer has submitted your claim to its workers’ compensation insurance carrier.
  • Consult with an experienced Florida workers’ compensation attorney.

The insurance carrier will likely contact you to get additional information. Anything you say to a workers’ comp claim adjuster can be used in the evaluation of your claim.
