How our team can help you with your work injury claim

If you suffered an injury at work due to conditions at your workplace, a Florida work injury lawyer from Berlin Law Firm can help you file a worker’s comp claim to get the maximum possible benefit.

Workers’ compensation is meant to cover lost wages and medical bills after an on-the-job injury. Unfortunately, too often workers in Florida do not receive the full protection they deserve. Employers and insurance companies put up significant barriers to make the workers’ comp process challenging. A capable and experienced law firm like ours can level the playing field.

Many times, a completely legitimate workers comp claim will be denied by the insurance company. This isn’t supposed to happen, but as lawyers who have worked on these cases for decades, we know full well that it does. Thankfully, the story is far from over if your workers’ comp claim is denied. We can help you build a strong appeal to get the funds you need after a workplace accident.

Your Rights After a Work Injury

By law, your Florida employer cannot stop you from filing a workers’ compensation claim when you suffer a work-related injury. Further, your employer cannot fire you for filing that claim. Florida, however, is a right-to-work state that favors employers and insurance companies over employees. Your employer can always terminate you on grounds other than your filing of a workers’ comp claim, for example, that your performance is sub-par or your position is no longer needed.

Do not hesitate to call our Florida workers’ compensation attorneys if you suspect that your job is at risk because you filed a workers’ comp claim. Our attorneys will help you get the workers’ comp benefits you are entitled to receive and fight to preserve your job and position while you recuperate.

Compensation for a Workplace Injury

If you file a timely claim and your employer’s insurer complies with its obligations, your Florida workers’ compensation benefits will begin as of the 7th day after you suffer an on-the-job injury. Under certain circumstances, you may be able to recover benefits retroactively for those first seven days if your injury results in a disability that extends more than 21 days.

Your workers’ comp benefits will include:

  • Replacement of a portion of the lost wages that you could earn while your injury heals
  • Payments for medical costs and expenses
  • Compensation for impairments caused by your injuries
  • In the tragic event of a fatality, your family can claim specific death benefits

The workers’ compensation benefits you receive will depend on the extent of your injury, the level of your impairment, and whether you are partially or fully disabled and temporarily or permanently disabled.

What to Do After Suffering an Injury in the Workplace

When you are hurt as a result of an on-the-job accident, you should:

  • Notify your employer in writing about the accident and your injuries promptly after your accident, and in any event no later than 7 days after the accident. Use the First Report of Injury Florida Form to provide that notice.
  • Collect and retain evidence about the accident, including photographs of the accident site and names and contact information of witnesses.
  • Get prompt medical treatment for your injuries.
  • Verify that your employer has submitted your claim to its workers’ compensation insurance carrier.
  • Consult with an experienced Florida workers’ compensation attorney.

The insurance carrier will likely contact you to get additional information. Anything you say to a workers’ comp claim adjuster can be used in the evaluation of your claim. When you retain an attorney to help you with your claim, he or she will take that burden off of you and handle all communications with the adjuster. Read more about the process here.
